Prices and validity: All prices quoted to the Client are net in U.S. Dollars. Newgateway Travel Int'l also warrants that the prices quoted to the Client are correct at the time of issuance of Client's brochure but are subject to change in line with market, tax, and currency fluctuation, with or without prior notice.

Payment: Upon confirmation of a reservation, a 30% (thirty per cent) deposit is requested and the balance of the total package tour price should be paid at least 30 days (thirty days) before starting date of the tour, or otherwise Newgateway Travel Int'l may cancel the bookings without any refund of the sums already paid to Newgateway Travel Int'l by the Client. Cash or credit card or travelers' cheques shall execute the Client's payment. Except for cash payment, service charge may be added. In case credit facilities has been agreed with the Client, payment shall be executed by telegraphic transfer to the following bank accounts:

Cancellation: Newgateway Travel Int'l does not levy Charges for cancellation of booking but if hotels, carriers and other contractors apply charges for cancellation, the Client shall be liable to pay those charges to Newgateway Travel Int'l.

Liability: Newgateway Travel Int'l always undertakes everything within its power to exceed the Clients' expectation in terms of quality and value. The understanding is that Newgateway Travel Int'l acts as intermediary between the Client and airlines, hotels, transport operators, local tourist offices providing services to the Client. Newgateway Travel Int'l shall in no event be liable to the Client by reason of unsatisfactory services provided to the Client by third parties or by way of indemnity, for any loss, injury, delay, change in schedule or other adverse events beyond the control of Newgateway Travel Int'l. The Client warrants that Newgateway Travel Int'l shall not be responsible and liable for additional expenses and damages due to any delay, accidents, and action of god, unrest, political action.

Claims: All disputes, claims and litigation regarding the services shall first be settled by way of negotiation and mutual understanding. In the event such negotiation and mutual understanding would fail, the disputes, claim and litigation shall finally settled by arbitration of the Vietnam International Arbitration Center at the Chamber of Commerce and Industry of the Socialist Republic of Viet Nam. All claims must be submitted in writing within 14 days after the end of the services.
